Terms and Conditions

Updated on 14 October 2026.

This page sets out the Terms and Conditions governing the use of this website (www.briel.pt) and the purchase of products through it by any customer.

To complement the information presented here, please also read the Privacy Policy.

Preamble

This website is operated by: PFVA – PLANEAR, FAZER, VERIFICAR, AGIR, LDA Rua da Alagoa, n.º 100, S. Mamede d’Este 4715-533 Braga, Portugal NIPC: 515142360 Share capital: €5,000

These conditions are agreed between PFVA – Planear, Fazer, Verificar, Agir, Lda (hereinafter “BRIEL”) and any person who wishes to make a purchase through this website, hereinafter the “USER”.

These conditions apply exclusively to natural persons and not to traders.

By using this website or making a purchase through it, the parties agree that their relationship will be governed exclusively by the general conditions and policies described here. BY USING THIS WEBSITE, THE USER ACCEPTS THESE TERMS AND CONDITIONS. IF THE USER DOES NOT ACCEPT THEM, THE USER MUST NOT USE THIS WEBSITE. We therefore advise the USER to read this document carefully BEFORE using the website to buy.

We may also change these Terms and Conditions from time to time. Whenever you wish to use our website, you should check these Terms and Conditions to make sure you understand the terms that apply at that time. We also advise you to read the Privacy Policy.

These conditions apply for the entire duration of the services offered by BRIEL.

Article 1 – Purpose

These conditions aim to define the general conditions of sale established between BRIEL and the USER, from the moment of ordering through the various services provided by BRIEL, such as payment methods, delivery conditions and the exchange or return of purchased products.

Article 2 – Products

The items for sale are presented and described as accurately as possible. If, despite our precautions, any errors occur on the website, BRIEL cannot be held liable for them.

Please note that, in some cases, the colours of the products shown on this website and the colours of the products delivered may differ slightly – this is because colour balance differs from screen to screen.

All products benefit from a contractual warranty, without prejudice to the 3-year legal guarantee (Decree-Law no. 84/2021 of 18 October). The legal guarantee also applies to lack of conformity arising from the packaging. If you receive a defective product or open or damaged packaging, the USER must report it, stating the order number and a description of the defect, by email to apoioclientebriel@bramp.pt or by post to the address above. BRIEL will take steps to resolve the matter as quickly as is possible and reasonable, in direct contact and with the agreement of the USER.

Article 3 – Purchases

The minimum purchase value on this website is €20 (twenty euros), including VAT.

To make a purchase on this website, and if you are a new USER, you must register (see Article 7 below). By making the purchase, understood as the moment of payment, the USER unequivocally expresses their full acceptance of these Terms and Conditions and of all the information provided regarding price, reference, weight and description of the product(s) they chose to buy, as shown on their order form.

To complete registration on this website you must provide your personal data, such as name, address and email address, among others, which will be requested on the order form, and you must fill in all mandatory fields. The USER agrees that the content they provide when registering on this website is not misleading and is true, accurate and complete in all respects, and that they will inform BRIEL, or update their data in their private account area, whenever an update is needed.

It is accepted between the parties that any dispute on these points will be resolved through the direct exchange of information and with all the guarantees mentioned in this document. Should a product ordered be unavailable for delivery, BRIEL undertakes to inform the USER immediately by email or telephone and to refund any amounts already paid within a maximum of 30 (thirty) days from the date it becomes aware of the unavailability.

Article 4 – Prices

Prices are in euros (€), with taxes and duties included. The prices shown take into account the VAT applicable on the day of the order. Any change in the applicable VAT will always be reflected in product prices.

Prices and product specifications are subject to change without notice. When processing your order, any pricing error that may be displayed on the website due to technical anomalies will be detected. In that case, the USER will be contacted. If the product price displayed on the website is in fact lower, the difference is refunded. If the price is higher, the USER will be contacted and may accept or cancel the order.

Article 5 – Payment

Payment may be made through the various means available (Multibanco, MBway, PayShop and bank transfer) on this website, at the end of the purchase process (checkout).

By completing the payment process and clicking the “Place order” button, you are making a binding offer to enter into a purchase contract; however, all orders sent by the buyer are subject to our acceptance, at our sole discretion. We are free to refuse your order, at our sole discretion, for any reason, without liability and in accordance with applicable law. Examples of situations in which we may not accept your order include: a) unavailability of the products shown on the website and/or incorrect price or description d) if we are unable to obtain authorisation or validation of your payment f) if there is reason to believe that you have breached these Terms and Conditions h) if we have reason to believe that you are not a consumer but a commercial buyer

If we cannot accept your order, we will let you know and will not charge you for the product.

The final validation of the order, in accordance with the legal provisions, constitutes proof and makes the amounts shown on the order receipt payable. Validation has the value of a signature and of acceptance of all operations carried out on the website.

For any payment method, the USER has 24 hours to make payment. After that period, the shopping cart is emptied and the order is void. Please note that we will only ship your order once your payment has been duly received.

Article 6 – Shipping

Order shipping is available to mainland Portugal and the Islands and to several countries around the world.

The ordering system automatically calculates the shipping cost.

International services are not exempt from the customs rules established for the clearance and entry of goods in the destination countries.

All shipments to non-EU countries will pass through customs, which may affect their transit. Clearance costs must be paid by the USER, and some type of document may be requested. If any payment is due, BRIEL will inform the USER.

Article 7 – Order Acceptance and Delivery

All orders, barring exceptional events or stock shortages, will be shipped within 5 business days. Delivery times vary depending on the destination.

The purchased products may be delivered to the address given by the USER, simply by entering the address in the corresponding fields of the online order form.

Delivery will be made by the carrier. If you are not present at the address given, a notice will be left informing you of the delivery attempt. The courier will contact you to arrange a new delivery.

IMPORTANT: Delivery will under no circumstances be made to PO boxes.

Article 8 – Returns and Exchanges

In accordance with the legislation in force in the European Union, all items may be exchanged or returned except those marked otherwise. In the unlikely event of any complaint about products bought on this website, the USER has a period of 14 (fourteen) days from the date of receipt of the order to exchange or return the items ordered.

If there is a lack of conformity, the USER may return the items and may choose between replacement or termination of the contract, under the applicable legal terms.

NEVER return an item without first contacting BRIEL. Our team will inform you of the correct procedure and the steps to take. In all cases of requests for exchange or return, the USER must contact our Customer Service using the address above; or by email at apoioclientebriel@bramp.pt; or by calling +351 253 304 260, Monday to Friday from 10:00 to 17:00.

You may return or exchange the item provided it is in the same condition in which it was sold, with original labels and packaging and accompanied by all the accessories that make it up.

The USER has two ways to exchange or return the item: 1) directly at the Briel counter, Parque Industrial de Sobreposta, Rua da Alagoa, São Mamede Este, 4715-533 Braga, Portugal or 2) via a carrier, which may be hired directly by the USER or by using the contract BRIEL has with its own carrier

The USER must pack the item(s) properly and bear the shipping costs (if using our carrier, this cost will be communicated at the time of return).

The usual procedure for the USER to make an exchange or return is as follows: a) the USER must contact our Customer Service team, stating the request and the details of what they wish to do (exchange or return) b) the USER must send a clear photo or video of the damaged or defective product and of the shipping packaging b) our team will review it before we can consider issuing authorisation to send us the product. Please use good lighting and a close distance so that we can identify and verify the problems. Send the photograph to apoioclientebriel@bramp.pt.

In the case of an exchange, if the new order costs more, the USER must pay the difference, either by adding the payment of the balance to the exchange request or by paying when collecting the new order.

In the case of a refund request for an item bought at a reduced price due to a special offer, Briel will refund the amount actually paid by the User and not the full price on the date of return.

In the case of a return, the refund of the purchase price will be made after validation that the return conditions described above have been met, and BRIEL has up to 15 days to do so from the moment the item(s) are received at the warehouse.

Article 9 – Minors

Use of our website by a minor (under 18 years of age) is strictly subject to the consent of their parents or legal guardians. We strongly advise parents who allow their children to use this website to discuss all aspects of online safety and the potential risks involved with them.

Article 10 – Consequences

If we suspect, become aware, or have reason to believe that the user has breached any of the provisions of these Terms and Conditions, we may (without prejudice to our other rights and remedies) immediately take the measures we deem appropriate, including: a) Immediately, temporarily or permanently suspending the USER’s right to use this website b) Immediately, temporarily or permanently removing any post or material uploaded by the USER to our website c) Issuing a warning to the USER d) Disclosing information to law enforcement authorities, to the extent reasonably necessary

Article 11 – Liability

BRIEL has only an obligation of means with regard to access to the website, the ordering process, delivery of products and subsequent services, and excludes any liability for any inconvenience or damage inherent to the misuse of the Internet, in particular service interruptions, external intrusions by hackers or malicious computer viruses.

Except in any cases of guarantee, any operation carried out between BRIEL and the USER which is not contested within 90 (ninety) days from the date it takes effect may not give rise to any claim.

Article 12 – Intellectual Property

All data and all content in general on this website are the property of BRIEL and are protected under the general terms of the law and by national and international intellectual property legislation. Total or partial reproduction of the content, identity or ideas for commercial purposes, or their distribution or incorporation in any other physical or online location, in any format, is strictly prohibited. Likewise, none of these items, or any others, may be reproduced without the prior authorisation of BRIEL.

A USER who has a personal website and wishes to place, for personal use, a simple direct link to www.briel.pt on their site must request authorisation from Briel. This will not, in this case, imply an implicit affiliation or partnership agreement.

Furthermore, any hypertext link to www.briel.pt using framing or in-line linking techniques is formally prohibited.

In all cases, any link, even if tacitly authorised, must be removed upon a simple request by email from BRIEL.

Article 13 – Entire Agreement

These “Terms and Conditions” constitute the entire agreement between the parties in question.

Should any clause of these conditions become null and void as a result of a legislative or regulatory change or a court ruling, this shall in no case affect the validity and observance of the remainder.

Article 14 – Evidence

The computerised records, kept securely in BRIEL’s computer systems, are considered evidence of the communications, orders and payments exchanged between the parties.

Article 15 – Retention and Archiving of Transactions

Orders and invoices will be archived on a reliable and durable medium so as to constitute a faithful and lasting copy.

Article 16 – Governing Law and Jurisdiction

These Terms and Conditions and the other policies published on this website are governed by Portuguese law. Any legal issues arising from these Terms and Conditions will be settled by the courts of the district of Braga, Portugal, with express waiver of any other.

Alternatively, in the event of a consumer dispute, the consumer may turn to the alternative consumer dispute resolution bodies listed on the “Dispute Resolution” page.
